Waiver, Assumption of Risk and Release of Liability
Effective October 15, 2026 · Version 2026-10-15
Please read this carefully. It affects your legal rights, including your right to sue. By ticking the box that accepts this Waiver, you sign it electronically. Your acceptance, the date, and this version are recorded.
In this Waiver, "Kentro" and the "Released Parties" mean Kentro and its owners, members, officers, directors, employees, contractors, agents, partners, successors and assigns.
1. What you are doing
Kentro guides you through body scans (standing still, overhead squats, single leg squats and similar movements in front of a phone camera) and corrective routines (stretching, mobility, release, activation and strengthening exercises). Your participation is voluntary.
2. The risks
Physical activity carries risks, some of them serious. They include, among others:
- Muscle strains and pulls, sprains, tendon, ligament and joint injuries, back and neck injuries.
- Losing your balance and falling, especially during single leg and overhead movements, and injuries from falls.
- Aggravating an existing injury, condition, surgery or pain.
- Dizziness, fainting, abnormal blood pressure or heart rhythm, heart attack, stroke, and in rare cases death.
- Hazards around you: furniture, walls, slippery or uneven floors, poor lighting, pets, children, and the phone or its stand.
- Relying on results that are estimates from a phone camera and can be wrong, incomplete, or misread.
3. What you confirm
- You are 18 or older (or a parent or legal guardian accepting for a minor, see section 8).
- You have consulted, or will consult, a physician before starting any exercise program if you have any health concern, and you are not aware of any reason you should not take part.
- You will answer the safety check before each scan honestly, follow its advice, and stop immediately if you feel pain, dizziness, shortness of breath, or anything unusual.
- You will move only within your own limits, in a clear and safe space, with a chair or wall within reach for balance movements.
- You understand Kentro is not a medical device, does not diagnose, treat, cure or prevent any disease or injury, and is not a substitute for a doctor, physical therapist or other licensed professional.
4. Assumption of risk
You knowingly and voluntarily accept and assume all risks of injury, illness, death and property damage arising from using Kentro and doing any scan, routine or exercise, whether those risks are known or unknown, and including risks arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law.
5. Release and waiver of claims
To the fullest extent permitted by law, you release, waive, discharge and promise not to sue the Released Parties for any and all claims, demands, losses, damages, liabilities and expenses of any kind (including for personal injury, illness, death, or property damage) arising out of or related to your use of Kentro, its scans, results, routines, exercises, content, messages, AI features, or any trainer you connect with through it, including claims based on the ordinary negligence of the Released Parties. This release does not apply to gross negligence, willful misconduct, or anything else that cannot be released under applicable law.
6. Indemnity
You agree to defend, indemnify and hold harmless the Released Parties from any claim, loss, or expense (including reasonable attorneys' fees) brought by you or on your behalf, or by your spouse, children, heirs, estate or anyone claiming through you, arising out of your use of Kentro or your breach of this Waiver or the Terms of Service.
7. Trainers
Trainers, coaches and therapists who use Kentro are independent. They are not employed, supervised or endorsed by Kentro, and Kentro does not control the guidance they give. Any claim about a trainer's services is between you and that trainer, and this Waiver releases the Released Parties from claims arising from a trainer's acts or omissions.
8. Minors
Kentro accounts are for people 18 and older. A trainer may scan a minor only with a parent or legal guardian's permission. A parent or guardian who permits a minor to use Kentro accepts this Waiver on the minor's behalf and on their own behalf, and agrees to indemnify the Released Parties for any claim brought by or for the minor, to the fullest extent permitted by law.
9. General
- This Waiver is intended to be as broad and inclusive as the law of California allows. If any part is held invalid, the rest stays in full force and effect.
- This Waiver is part of, and governed by, the Terms of Service, including its dispute resolution and arbitration section.
- It binds you, your heirs, executors, administrators, assigns and anyone claiming on your behalf, and stays in effect after you stop using Kentro.
- Your electronic acceptance has the same effect as a handwritten signature under the federal E-SIGN Act and applicable state law.
By accepting, you confirm that you have read and understood this Waiver, that you are giving up substantial rights, including the right to sue, and that you accept it freely and voluntarily.
